Terms of Service

§ 1. Definitions

The terms used in these Terms of Service have the following meanings:

  • Platform — the "The Balance Space" mobile application and the thebalance.space website, through which the Service Provider delivers the Services.
  • User — a natural person who uses the Platform.
  • Account — an individual User profile on the Platform, created upon registration.
  • Classes — pilates or other fitness sessions offered through the Platform.
  • Membership — entitles the User to participate in a specified number of Classes within a defined period.
  • Payment Operator — PayNow (mBank S.A., ul. Prosta 18, 00-850 Warszawa), which handles online payments on the Platform.

§ 2. General Provisions

  1. These Terms of Service set out the rules for using the Platform, including the conditions for booking Classes, making payments, and purchasing Memberships.
  2. By using the Platform, the User accepts these Terms of Service.
  3. The Service Provider renders services by electronic means in accordance with the Polish Act of 18 July 2002 on the Provision of Electronic Services (Ustawa o świadczeniu usług drogą elektroniczną).
  4. The Platform is currently available as a web application. A mobile application (iOS, Android) is in development and will be made available in the future.

§ 3. Registration and User Account

  1. Registration on the Platform requires providing a mobile phone number or an e-mail address.
  2. Identity verification is performed using a one-time password (OTP) sent to the provided phone number or e-mail address.
  3. The User undertakes to provide truthful personal data.
  4. Each User may hold only one Account on the Platform.
  5. The User may delete their Account at any time through the application settings. Account deletion is irreversible.

§ 4. Class Bookings

  1. The User may book Classes through the Platform, provided they have a sufficient number of credits in their Account or an active Membership.
  2. Bookings can be made within the booking window, the duration of which is determined by the Service Provider (by default, 7 days before the Class).
  3. Before the booking window opens, the User may sign up for the waitlist.
  4. The User may reserve a regular spot for recurring Classes on selected days of the week. Once this feature is enabled, the Platform automatically books the User into upcoming occurrences of those Classes as they become available.
  5. The number of places in each Class is limited. Bookings are processed on a first-come, first-served basis.

§ 5. Payments

  1. Payments for Memberships and individual Classes are processed through the Payment Operator — PayNow (mBank S.A.).
  2. Available payment methods include: bank transfers, BLIK, and payment cards — in accordance with the Payment Operator's offering.
  3. Prices for Classes and Memberships are quoted in Polish zloty (PLN) and include VAT, if applicable. The current price list is available on the Offer & Pricing page.
  4. Payment is required at the time of booking or purchasing a Membership.
  5. The service (Membership or individual Class) is activated immediately upon payment confirmation by the Payment Operator. For Memberships, the 30-day validity period begins from the moment the payment is recorded.
  6. The Service Provider issues an electronic transaction confirmation. Transaction history is available in the User's profile within the application.

§ 6. Memberships

  1. A Membership entitles the User to participate in a specified number of Classes within a defined period (30 days from the activation date).
  2. A Membership is registered to a specific User and is non-transferable.
  3. Unused Classes within a Membership do not carry over to the next billing period, unless the terms of a specific Membership provide otherwise.
  4. Available memberships and their prices are published on the Offer & Pricing page and in the The Balance Space application.
  5. The Service Provider reserves the right to change the price list. Price changes do not affect Memberships purchased before the date of the change.

§ 7. Cancellations and Refunds

  1. The User may cancel a booking free of charge up to 24 hours before the scheduled Class time.
  2. If a booking is cancelled less than 24 hours before the Class, the funds may not be refunded.
  3. Refunds for unused Memberships are available within 14 days of purchase, provided the User has not attended any Classes under the Membership (right of withdrawal from a distance contract under the Polish Act of 30 May 2014 on Consumer Rights — Ustawa o prawach konsumenta).
  4. In the event of a justified complaint, a refund is made to the account from which the payment was made, within 14 business days.
  5. To submit a refund request, the User should contact the Service Provider at: studio@thebalance.space.

§ 8. Liability

  1. The Service Provider makes every effort to ensure the Platform operates correctly and without interruption.
  2. The Service Provider is not liable for interruptions in the Platform's operation caused by circumstances beyond its control, including technical infrastructure failures.
  3. The User participates in Classes at their own risk. The Service Provider recommends consulting a physician before commencing physical activity.
  4. The Service Provider is not liable for damages resulting from use of the Platform in a manner inconsistent with these Terms of Service.

§ 9. Participation at Own Risk and Limitation of Liability

  1. The User participates in Classes and other physical activity voluntarily and at their own risk. The User acknowledges that they are aware of the nature of the physical exertion involved in the Classes.
  2. The User is responsible for their own health and for assessing whether their fitness and state of health permit safe participation in the Classes. The Service Provider recommends consulting a physician before commencing physical activity, in particular where any health contraindications exist.
  3. The User should not take part in Classes when ill, injured, feeling unwell, or where there are medical contraindications to physical exertion.
  4. The User is responsible for injuries and harm to health arising in connection with their participation in the Classes, to the extent that such injuries result from their state of health, failure to follow the instructor's guidance, or improper performance of the exercises.
  5. The User is responsible for personal belongings brought onto the premises, as well as for any accompanying persons and any items they bring or introduce onto the premises.
  6. Subject to paragraph 7 below, the Service Provider's liability towards a User who is a consumer is limited to the extent permitted by mandatory provisions of applicable law, including consumer-protection law.
  7. Nothing in these Terms of Service excludes or limits the Service Provider's liability for damage caused intentionally or through gross negligence, for personal injury, or for any other liability that cannot be excluded or limited under applicable law. Any contractual provision purporting to exclude such liability is void.
  8. The instructor has the right to deny the User admission to the Classes, or to remove them from participation during the Classes without refunding the cost of the session, if the User's appearance or their behaviour creates a risk of injury.
  9. If the User feels unwell or sustains an injury during the Classes, the User is obliged to report it immediately — before leaving the studio — to the instructor or administrator, so that the incident can be recorded.

§ 10. Personal Data Protection

  1. The controller of Users' personal data is the Service Provider.
  2. Personal data is processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR) and the Polish Act on Personal Data Protection.

§ 11. Complaints

  1. The User has the right to file a complaint regarding the operation of the Platform or the services provided.
  2. Complaints should be sent to the e-mail address: studio@thebalance.space.
  3. A complaint should include: the User's full name, the e-mail address associated with the Account, a description of the issue, and the expected resolution.
  4. The Service Provider will review the complaint within 14 days of receipt and will inform the User of the outcome by electronic means.

§ 12. Out-of-Court Dispute Resolution

  1. Consumers have the right to use out-of-court dispute resolution methods, including mediation or arbitration.
  2. Detailed information is available on the website of the Polish Office of Competition and Consumer Protection (Urząd Ochrony Konkurencji i Konsumentów): www.uokik.gov.pl.
  3. Consumers may use the EU Online Dispute Resolution (ODR) platform: ec.europa.eu/consumers/odr.

§ 13. Final Provisions

  1. The Service Provider reserves the right to amend these Terms of Service. Users will be notified of any changes through the Platform at least 14 days in advance.
  2. Matters not covered by these Terms of Service are governed by Polish law.
  3. These Terms of Service enter into force on 1 March 2026.
